Definitions
Each of the terms mentioned below have in these Conditions of Sale for OlxKenya Service, also known as Oelex Kenya (hereinafter the "Conditions"), the following meanings:
- Announcement: Refers to all the elements and data (visual, textual, sound, photographs, drawings) presented by an Advertiser, under their sole responsibility, to buy, rent, or sell a product or service and broadcast on the Website and Mobile Site.
- Advertiser: Means any natural or legal person, of legal age, established in Kenya, who holds an account and has submitted an announcement on the Website. Any Advertiser must be connected to the Personal Account to deposit and/or manage its listings. The first deposit automatically entails the establishment of a Personal Account for the Advertiser.
- Personal Account: Refers to the free space that any Advertiser must create and connect to from the Website to disseminate, manage, and view their listings.
- OlxKenya (also Oelex Kenya): Means the company that publishes and operates the Website and Mobile Site {YourCompany}, registered at the Trade and Companies Register of {YourCity} under the number {YourCompany Registration Number}, with its registered office at {YourCompany Address}.
- **Customer Service**: Means the department of OlxKenya (also Oelex Kenya) to which the Advertiser may obtain further information. This service can be contacted via email by clicking the link on the Website and Mobile Site.
- OlxKenya Service (also Oelex Kenya Service): Means the services made available to Users and Advertisers on the Website and Mobile Site.
- Website: Means the website operated by OlxKenya (also Oelex Kenya), accessed mainly from the URL https://OlxKenya.co.ke, allowing Users and Advertisers to access the OlxKenya Service (also Oelex Kenya Service) via the internet.
- Mobile Site: Is the mobile site operated by OlxKenya (also Oelex Kenya), accessible from the URL https://OlxKenya.co.ke, allowing Users and Advertisers to access the OlxKenya Service (also Oelex Kenya Service) via their mobile phone.
- User: Any visitor with access to OlxKenya Service (also Oelex Kenya Service) via the Website and Mobile Site.
Subject
These Terms and Conditions of Use establish the contractual conditions applicable to any subscription by an Advertiser connected to their Personal Account from the Website and Mobile Site.
Acceptance
Any use of the Website by an Advertiser constitutes full acceptance of the current Terms.
Responsibility
OlxKenya (also Oelex Kenya) cannot be held liable for non-performance or improper performance beyond its control, either due to the Advertiser or a case of force majeure.
Modification of these Terms
OlxKenya (also Oelex Kenya) reserves the right, at any time, to modify all or part of the Terms and Conditions. Advertisers are advised to consult the Terms to be aware of any changes.
Miscellaneous
If any part of the Terms is found to be illegal, invalid, or unenforceable for any reason, the provisions in question will be deemed unwritten without affecting the validity of the remaining provisions, which will continue to apply between Advertisers and OlxKenya (also Oelex Kenya). Any complaints should be addressed to OlxKenya Customer Service (also Oelex Kenya Customer Service).
